Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) applies to the use of the services of Atmosera and its affiliated companies (“Atmosera”) by its customers (the “Services”). This AUP supplements, but does not supersede, the agreements that customers or other users (“You”) have with Atmosera. The AUP also applies, and should be communicated, to each Atmosera customer’s own customers and/or end users that utilize the Services provided through the Atmosera customer. In the event of any conflict between a customer’s agreement and the AUP, the AUP will govern. By using the Services, you agree to the latest version of this AUP. Please read it carefully.
Atmosera has published this AUP to help ensure that the Services provided to our customers are of the highest quality, and to help protect the privacy and security of our customers, systems, and networks, while also encouraging responsible use, including compliance with applicable laws. Additionally, the AUP describes types of use of the Services that are prohibited. Atmosera may at its sole discretion determine whether a use of the Services is a violation of the AUP. Atmosera in no way intends to monitor, control, or censor communications or content that a customer may acquire, transmit, or store on or via Atmosera’s network. However, when we have knowledge of a violation of this AUP, we reserve the right to take such action as is necessary to address the violation, as referenced below.
As used herein, “Content” shall mean all information made available, displayed, transmitted or retransmitted in connection with customer’s use of the Services (including, without limitation, information made available by means of a “hot link”, a third party posting or similar means) including all trademarks, service marks and domain names contained therein as well as the contents of any bulletin boards, social sites or chat forums, and, all updates, upgrades, modifications and other versions of any of the foregoing.
The following are prohibited uses of the Services under this AUP. These descriptions are guidelines and are not intended to be comprehensive in nature.
The Services may not be used in connection with any criminal or civil violations of local, state, provincial, federal, or international law, treaty, regulations, court order, ordinance, administrative rule, or other government requirements.
The Services may not be used to transmit, re-transmit, host or store any Content or to engage in any activity that infringes or facilitates the infringement of the intellectual property rights or privacy rights of any individual, group or entity, including but not limited to any rights protected by any copyright, patent, trademark, trade secret, trade dress, right of privacy, right of publicity, moral rights or other intellectual property right now known or later recognized by statute, judicial decision or regulation.
The Services may not be used in connection with any attempt to damage, violate, facilitate or assist in the violation of the security of any network, service, or other system, data or Software. Prohibited acts include, but are not limited to, hacking, cracking into, monitoring, accessing or using systems or networks without authorization; scanning ports; forging of any TCP/IP packet header or any part of the header information in an email or newsgroup posting; conducting or participating in denial of service attacks; and distributing viruses, time bombs, worms, botnets, zombies, cancelbots or other harmful Software computer program routines designed to damage, intercept or seize control of systems, Software or data. Atmosera customers are responsible for maintaining the basic security of their systems to prevent use of their system in a manner which may result in a violation of this AUP, such as properly securing mail servers to prevent distribution of spam or other unsolicited commercial email (as defined below), and properly securing FTP servers to prevent illegal distribution of licensed Software. Customers also are responsible for implementing preventive or remedial actions on vulnerable or exploited systems to prevent continued abuse.
The Services may not be used to transmit, re-transmit, host or store materials or Content that is of a threatening nature, including threats of death or physical harm, or that is harassing, libelous, and or defamatory, invasive of privacy rights, or to provide information or assistance in causing or carrying out violence against any government, organization, group or individual.
The Services may not be used to transmit, re-transmit, host or store for the distribution of offensive Content, including obscene, pornographic, indecent, and hateful materials.
Spam is an unacceptable use of the Services and is a violation of the AUP. Prohibited acts include, but are not limited to, any of the following activities:
- Posting a single message or messages similar in content, to more than five online forums or newsgroups.
- Posting of messages to online forums or newsgroups that violate the rules of the forums or newsgroups.
- Collecting the responses from unsolicited email.
- Sending any unsolicited email that could be expected, in Atmosera’s sole discretion, to provoke complaints.
- Sending email with charity requests, petitions for signatures, or any chain mail related materials.
- Sending unsolicited email without identifying in the email a clear and easy means to be excluded from receiving additional email from the originator of the email.
- Sending email that does not accurately identify the sender, the sender’s return address, and the email address of origin.
- Using another site’s mail server to relay mail without the express permission of the site.
- Using the Services to violate an Internet Service Provider’s acceptable use policy and/or terms of service.
- Sending emails that result in Atmosera-provided IP address(es) being blocked or black-holed by third party spam protection related services.
A violation of this AUP by someone having only indirect access to the Services through a Customer or other user will be considered a violation by the Customer or other user, whether or not with the knowledge or consent of the Customer or other user. In addition, this AUP applies to any email or Content transmitted by a customer or on its behalf using a Atmosera account as a mailbox for responses or promoting Content hosted or transmitted using the Services, or indicating in any way that Atmosera was involved in the transmission of such email or Content.
Actual, suspected or alleged violations of this AUP may result in a demand for immediate removal of offending Content, immediate temporary or permanent filtering, blocked access, suspension or termination of the Services, or other action appropriate to the violation, as determined by Atmosera in its sole discretion. When feasible, it is Atmosera’s preference to give notice so that violations may be addressed voluntarily; however, Atmosera reserves the right to act without prior notice when necessary, in its sole discretion, to avoid an interruption in Service or a negative impact on network capacity or performance. Atmosera may involve, and will cooperate with, law enforcement if criminal activity is suspected. Violators may also be subject to civil or criminal liability under applicable law. Refunds or credits are not issued in connection with actions taken for violations of this AUP.
Any complaints regarding violations of this AUP by an Atmosera customer should be immediately directed to the Atmosera Service Desk by calling 1- 800-207-0740 or sending an email to support@Atmosera.com. Where possible, include details that would assist Atmosera in investigating and resolving the complaint (i.e. expanded headers and a copy of the offending transmission).
Revisions to the Atmosera AUP
Atmosera may modify this AUP at any time, effective when posted to the Atmosera website located at www.atmosera.com

The data we collect about you
Personal data means any data that identifies or can be used to identify a person. It does not include data where the identity has been removed (anonymous data).
The types of personal data we collect from or about you depends on which group you fall into. Personal information may include email address, postal address, name, payment information, mobile or landline telephone numbers as well as other personal information you may provide to us.
Unless you specifically inform us, we do not collect any details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. Nor do we collect any information about criminal convictions and offenses.
How your data is collected
The data that you may provide to us will generally be collected when you complete and submit forms on our website or contact us.
The data that we collect about you may be obtained:
- From third-party analytics providers such as Google Analytics
How we use your data
We will only use your personal data when the law allows us to. We will generally rely on one of three legal grounds for using your personal data:
- Where we need to perform the contract we are about to enter into or have entered into with you (see our Terms & Conditions)
- Where necessary for our legitimate interests or those of a third party, provided those interests do not override your fundamental rights and interests
- Where we need to comply with a legal or regulatory obligation
Generally, we do not rely on consent as a legal ground for using your personal data, except in relation to sending you marketing by email or text message. You have the right to withdraw your consent to marketing at any time either by contacting us, clicking the unsubscribe link in an email, or replying to a text message with the required words notified to you in each text message.
Who we share your data with
We do not sell any personal data for commercial purposes. However, we will share your personal data:
- With service providers including our hosting provider, email marketing platform provider, online survey provider, analytics providers, lead generation providers
- If you have consented to use sharing your details with carefully selected third parties whose products and services may interest you
How we keep your data secure
We have put in place appropriate security measures (for example, access to our website is secured using ‘https’ technology and access to payment card details is encrypted) to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. We also limit access to your personal data to those within our organization that have a need to access it. They will only process your personal data on our instructions and they are required to keep your personal data confidential.
How long we keep your data for
We will only keep your personal data for as long as necessary in connection with the purposes we collected it for and to comply with any legal, accounting or reporting requirements. To determine how long we keep your personal data for, we consider the amount, nature and sensitivity of the personal data, the purpose for which it was collected and the potential risk of harm from us continuing to keep it.
We will retain personal data relating to email marketing (see Marketing) until you unsubscribe or your email address has become permanently unavailable.
We will retain the analytical data collected about your use of our website for a period of 24 months. We may retain any data that does not identify you indefinitely.
Our email marketing campaigns can track whether you click any of the links contained in our emails. This helps us understand what the recipients of our emails have found interesting and to personalize the content of emails that we may send to you in the future.
We use tiny, invisible images called ‘pixels’ that are contained within emails to enable us to see:
- Whether you opened an email
- Where in the world the device used to open the email was located (based on your device’s IP address)
- The type of email client used to open the email
- Whether you shared the email on any social media platforms
- Whether you marked the email as spam
- Your overall level of engagement with our email marketing campaigns
We use these data to improve the format and quality of our email marketing campaigns.
